The Team
The role sits within the Markets Legal Practice in EMEA supporting the EMEA Regional Global Clearing Business.
The Role
The purpose of the role is to provide legal advice and support to the OTC Clearing business which forms part of the Global Clearing business at J.P.Morgan.  The business provides OTC Clearing services to a broad range of clients and holds memberships on 7 CCPs globally.
 Key responsibilities include:
  • Provide legal and regulatory support and advice to the Global Clearing business;
  • Focus on CCP Clearing rules and membership matters;
  • Clarify and high-light key issues/risks to the Global Clearing business.
  • Engaging with clearing houses with respect to new rules and arrangements impacting the business;
  • Review and advising upon a variety of legal opinions (e.g. jurisdictional, collateral and netting opinions);
  • Provide support in relation to the JP Morgan standard clearing agreement, execution agreements, credit support documentation, non-disclosure agreements, electronic trading agreements and custody agreements;
  • Work closely with Compliance and other legal teams in relation to market/regulatory developments or client contracts with cross-product impact (in particular, Derivatives, Regulatory Affairs, Prime Brokerage and Cash Equities legal teams);
  • Review of and advising in relation to regulatory change such as MiFID II, FCA CASS, EMIR and other regulations;
  • Review and approve or draft legal and regulatory disclaimers;
  • Assist with the legal and commercial settlement of any type of error or dispute (e.g. trading, booking, settlement etc) with clients, dealers and CCPs;
  • Draft tailored legal documentation, where required;
  • Participate in industry advocacy via industry groups (ISDA and FIA).
The following experience/skills are essential:
  • Prior experience in financial markets and trading/broking legal work;
  • Lawyer must be licensed to practice law and a member in good standing in the state/jurisdiction in which the position is based or otherwise in compliance with the in-house counsel registration rules of that state/jurisdiction
  • Regulatory and prior Futures & Options and OTC Clearing experience highly desirable;
  • Excellent understanding of the commercial, legal and regulatory environment in which the J.P.Morgan’s Global Clearing business operates;
  • Strong intellectual and legal skills;
  • Excellent drafting, written and oral communication skills;
  • Commercial and practical outlook, ability to handle a number of matters and to prioritise and re-prioritise in a pressurised commercial environment.
